Kleine apologie voor een zwakke rechtspraak

In september 2004 werd Nederland opgeschrikt door de gruwelijke dood van de driejarige peuter Savanna. Haar lijkje werd bij toeval door de politie gevonden in de kofferbak van haar moeders auto, toen die met haar toenmalige vriend op weg was haar te begraven. Het zes maanden oude zusje van Savanna zat op de achterbank. Uit het onderzoek dat volgt blijkt dat Savanna vermoedelijk door verstikking om het leven is gekomen. Haar moeder had het 'snotverkouden' kind een washandje in de mond gestopt en haar mond met een zwachtel dichtgesnoerd, zodat het kind de prop niet kon verwijderen. Het bleek echter niet de enige mogelijke doodsoorzaak. Savanna bleek voorafgaand aan haar dood ook aan de hals te zijn opgetild, geslagen en gekneveld onder een bed gelegd. Ook zat haar lichaam vol blauwe plekken en had ze diverse inwendige bloeduitstortingen. Bovendien was het kind ernstig ondervoed. Ze woog nog geen elf kilo en haar bloedsuikerspiegel bleek gevaarlijk laag.

De eurotop van 26 oktober had een eind aan de euro-crisis moeten maken, maar met de aankondiging van het Griekse referendum nam de verbijstering en  verwarring weer toe. Waarom lukt het Europa niet de crisis te bedwingen? Is dat te wijten aan de onvoorspelbaarheid van de financiële markten of is het veeleer te wijten aan een gebrek aan leiderschap?

Een wereld zonder financiële crises, omvallende banken en landen die balanceren op het randje van de afgrond: het lijkt een onrealistische wensdroom. Sinds een jaar of vijf sleept de wereldeconomie zich voort van de ene crisis naar de andere. Het begon in 2007 met de subprime mortgage (‘rommelhypotheken’) crisis, die een jaar later leidde tot een wereldwijde bankencrisis. Nationale overheden moesten banken redden. Op dit moment zuchten de Verenigde Staten en diverse landen in Europa onder torenhoge overheidsschulden.

Abstract  According to writers such as Nietzsche, Steiner, and Oudemans and Lardinois the tragic culture of the Greeks has become entirely alien to us. They argue that within the Christian and modern worldview there is no place for tragedy anymore. In this article it is claimed that this does not entail in any shape or form that tragic events cannot take place anymore within Christian and modern culture. In modern culture this particularly happens, with no lack of tragic irony, precisely in the domain in which we believed tragedy had been eliminated: (our interaction with) technology.

Although technological tragedies differ in many respects from classical tragedies, they also show deep continuities. Just as in the case of their classical models, the behavior of the tragic heroes of our time is characterized by miscalculation (hamartia), blindness (atè) with regard to the tragic reality and foolhardiness (hybris).Now, tragic events do not automatically raise tragic awareness. Tragedies are characterized by the fact that the tragic heroes – unlike the spectators – are unaware of the fate that is befalling them, and coming about because of them. But most tragedies also have a reversal of circumstances (peripéteia), a moment at which hopeful expectation crumbles and the hero suddenly becomes aware of his tragic position. Postmodernity is another way of saying that modern culture recognizes itself as tragic.

Two weeks ago, in his lecture in this series on Europe, Neal Ascherson asked two intriguing questions: ‘Where is Europe?’, and ‘When is Europe’. Intriguing because it turned out that these seemingly simply questions are very hard to answer. Today I want to add a third question, as simple as the other two and as difficult to answer. This question is: Whatis Europe? In a sense, we may regard this third question as the primordial one, as we can start our search for Europe in time and space only when we at least have a slight idea of whatwe are actually looking for. So the question I want to address this afternoon is: what is it that makes Europe European? And as the title of my talk already indicates, the answer I will defend today is that Europe first and foremost is a tragic continent.

One of the founders of modern hermeneutics, German philosopher Wilhelm Dilthey (1833-1911) confronted the question of how modern, postmetaphysical human beings can cope with the ambivalence, contingency, and finitude that fundamentally characterize their lives. This book offers a reevaluation and fresh analysis of Dilthey’s hermeneutics of life against the background of the development of philosophy during the past two centuries.

This work by de Mul is the definitive synthesis on Dilthey available in English. It not only develops the thought of Dilthey chronologically, it also sets his thought in an overall structure that he terms the Critique. This structure solves one of the major problems of Dilthey studies - how to organize his disparate thoughts when no definitive work of his exists. Until this book, most other treatments, while helpful and informative, have not managed to rise to the precision and clarity of this work.
One of most helpful aspects to this book is the author's ability to locate and identify the tensions in Dilthey and provide the structure that is needed to understand them. By describing how ambivalence, contingency, and finitude serve as structuring ideas to Dilthey's thought, the author saves a reader from finding Dilthey contradictory and incomprehensible.
One final aspect of praise for this work is the clarity of thought and writing. A helpful and detailed Table of Contents allows any reader to quickly discover the argument and structure of the book. In addition, most esoteric and technical terms and ideas (including many 19th Century German philosophical concepts) are explained quickly and understandably in a way that allows one unfamiliar with these ideas to follow. These explanations, however, do not sidetrack the argument from its purpose and therefore do not prove distracting to one more familiar with the history and ideas referenced.
In conclusion, after having read many works on Dilthey, I find this to be the clearest, most informative, and best written of them all. Not only will it introduce one to a great philosopher, it will also provide a synthesis of his thought that is invaluable.
